Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zvid platform, including:

  • The Zvid dashboard (e.g. dash.zvid.io)
  • The Zvid API (e.g. https://api.zvid.io)

By creating an account, using an API key, or sending JSON payloads to render videos, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Accounts and API Keys

1.1. Account Registration

To use certain features (e.g., dashboard and API access), you must create an account and provide accurate, complete, and up-to-date information.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Ensuring activities under your account comply with these Terms

1.2. API Keys

You may generate one or more API keys from the Zvid dashboard. API keys are tied to your account and are used to authenticate API requests.

You agree to:

  • Keep your API keys secret and secure
  • Not share your API keys publicly (e.g., in client-side code or public repos)
  • Immediately revoke or rotate keys you suspect are compromised

You are responsible for all activity performed using your API keys.

2. Use of the Service

2.1. JSON-to-Video Rendering

The Service allows you to submit JSON project payloads that describe:

  • Video configuration (width, height, duration, frame rate, resolution presets)
  • Visual elements (TEXT, IMAGE, VIDEO, GIF, SVG)
  • Audio elements
  • Subtitles and captions
  • Position, resize, anchor, animations, and transitions

Zvid uses these payloads to programmatically render videos, typically via a backend rendering engine (e.g., FFmpeg-based pipeline).

2.2. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe or misappropriate any third-party rights (including copyrights, trademarks, privacy rights)
  • Generate or distribute content that is illegal, harmful, defamatory, hateful, or abusive, or have pornographic.
  • Upload or reference malware, viruses, or malicious code
  • Attempt to bypass or interfere with security features, rate limits, or fair-use enforcement
  • Reverse engineer, decompile, or otherwise attempt to derive the source code of non-open-source components of the Service (except where permitted by law)
  • Overburden or disrupt the Service, servers, or networks

We reserve the right to suspend or terminate your account or API access if we reasonably believe you are violating these Terms or creating risk for the Service or others.

2.3. Rate Limits and Fair Use

We may apply rate limits, concurrency limits, or other usage caps to protect the stability of the platform.

You agree not to attempt to circumvent these limits (for example, by creating multiple accounts or using multiple API keys in a way that breaks our policies).

3. Content and Intellectual Property

3.1. Your Content

"Your Content" includes:

  • JSON project payloads you send (project configuration, visuals, audios, subtitles, etc.)
  • Media assets you provide or reference (images, videos, audio, SVGs)
  • Output videos generated from your inputs

You retain all rights to Your Content, subject to any obligations you may have to third parties.

You represent and warrant that:

  • You have all necessary rights, licenses, and permissions to provide Your Content to Zvid and to use it with the Service.
  • Your Content does not infringe or violate any third-party rights or applicable law.

3.2. License to Zvid

To operate the Service and render videos for you, you grant Zvid a worldwide, non-exclusive, royalty-free license to:

  • Process, store, and transmit Your Content as necessary to provide the Service
  • Generate video outputs and related artifacts (e.g., thumbnails, intermediate files)
  • Use de-identified or aggregated information derived from Your Content to improve the Service (e.g., performance metrics, non-identifying usage statistics)

We do not use Your Content to train generic models for third parties, including in de-identified or aggregated form.

3.3. Zvid Intellectual Property

Zvid and its licensors retain all rights, title, and interest in:

  • The Service, dashboard, and APIs
  • Underlying software, libraries, and rendering pipelines
  • Documentation
  • Logos, trademarks, and branding

Except for the limited rights expressly granted in these Terms, no license or right is granted to you by implication or otherwise.

4. Service Availability and Maintenance

We strive to keep the Service available and performant, but we do not guarantee:

  • That the Service will be uninterrupted, error-free, or available at all times.
  • That rendered outputs will always meet your specific quality or timing expectations.

We may from time to time:

  • Perform maintenance (including queue draining, system upgrades, or temporary suspension of renders)
  • Modify or discontinue certain features or APIs

Where reasonable, we will endeavor to notify you of planned maintenance or breaking changes via the dashboard, documentation, or email.

5. Beta Features

We may occasionally offer early access or beta features.

These features:

  • May be experimental and subject to change or removal
  • May have different reliability, performance, or documentation levels

You use beta features at your own risk, and we may terminate or change them at any time.

6. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that the Service will be uninterrupted, error-free, or completely secure
  • Any warranty regarding the accuracy, reliability, or completeness of any output videos or analytics

You are solely responsible for:

  • Reviewing output videos before using them publicly
  • Ensuring that use of the Service and outputs complies with applicable laws and third-party rights

7. Limitation of Liability

To the maximum extent permitted by law:

  • Zvid shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service.

These limitations apply whether the claims are based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless Zvid and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your Content (including any alleged infringement or violation of third-party rights)
  • Your violation of these Terms or applicable laws

9. Termination

9.1. By You

You may stop using the Service at any time. You may also request account deletion via the dashboard or by contacting support (subject to any data retention obligations we have under law).

9.2. By Zvid

We may suspend or terminate your account or API access if:

  • You violate these Terms or we reasonably suspect you are doing so
  • Your use creates security risk or potential harm to the Service or others
  • We are required to do so by law or by a regulatory authority

We will make reasonable efforts to notify you, where allowed by law and where feasible.

Upon termination:

  • Your right to use the Service stops immediately
  • Some sections of these Terms remain in effect (e.g., ownership, disclaimers, limitations of liability, indemnification, governing law)

10. Governing Law and Disputes

These Terms and any disputes arising out of or relating to them or the Service will be governed by and construed in accordance with the laws of [Insert Governing Jurisdiction], without regard to its conflict of law rules.

Any disputes shall be resolved in the courts located in [Insert Venue], and you consent to the jurisdiction of such courts. Where applicable law provides mandatory consumer rights or jurisdiction, those rights will remain unaffected.
